These Terms of Use govern access to and use of the pusto.sk website, apps, subdomains, APIs, communication channels, and related services (together, the “Platform”). By accessing or using the Platform, the user confirms that they have read, understood, and agree to be bound by these Terms. If the user does not agree, they must not use the Platform.
1. Operator and service role
The Platform is operated by Andrey Pustovoitov, acting as an individual, with contact address at Sacko 20a, Ukraine, no company registration number, contact email pusto.sk.com@gmail.com, and support email pusto.sk.com@gmail.com (the “Operator”, “we”, “us”). The Platform is an intermediary and aggregation service. We may publish listings submitted directly by users and may also index or display listings from public sources, including public Telegram channels or similar publicly accessible sources, where permitted by applicable law. We are not the seller, buyer, landlord, tenant, employer, recruiter, payment institution, broker, insurer, or guarantor in transactions between users or third parties unless we expressly state otherwise in writing for a specific service.
2. Eligibility and account rules
Users must be at least 18 years old or have the permission of a parent or legal guardian where local law permits such use. Users must provide accurate and up-to-date information when creating an account or submitting a listing. Each account is personal unless the account is opened on behalf of a company or other organization. Users are responsible for activities performed through their account and for maintaining the confidentiality of login credentials. We may require email verification, phone verification, Telegram verification, proof of identity, proof of student status, proof of company registration, or other reasonable checks before enabling certain features, ownership claims, or paid tools.
3. Listings and public source aggregation
The Platform may display listings for goods, services, jobs, accommodation, roommate search, or other categories made available through the Platform. When we display listings from public sources, we do not claim ownership of that source content. We may store, index, format, deduplicate, translate, classify, rank, and display public listings for search, moderation, fraud prevention, discoverability, and user convenience. Any person who believes that a public listing should be corrected, delisted, or linked to their verified account may contact us through the procedure described in these Terms and in the Privacy Policy.
4. User obligations
Users must comply with applicable law and with these Terms. Users must submit only content they are entitled to publish and must ensure that their listings are accurate, lawful, non-misleading, and not deceptive. Users must not impersonate another person, misrepresent availability, price, identity, qualifications, or location, or use the Platform to redirect users into scams, phishing, malware, or unlawful schemes. Users remain solely responsible for their content, communications, and transactions. Users should carry out their own checks before sending money, signing an agreement, or meeting offline.
5. Prohibited content and conduct
The following are prohibited: illegal goods; counterfeit goods; weapons where listing is unlawful or restricted; narcotics and controlled substances; stolen property; financial fraud; account theft; scams; adult sexual services; exploitative housing offers; discriminatory or unlawful job advertisements; content violating intellectual property rights; privacy-invasive doxxing; spam; malicious software; and any content that is unlawful in the relevant jurisdiction. We also prohibit attempts to evade moderation, repeated reposting of removed content, manipulation of rankings, fake reviews, mass scraping contrary to our rules, and any use that may disrupt the Platform or harm users.
6. Moderation and enforcement
We may use automated tools, manual review, user reports, trusted flagger signals where applicable, and internal heuristics to detect spam, fraud, unsafe listings, or policy violations. We may label, deprioritize, restrict, suspend, demote, request edits to, or remove content or accounts where reasonably necessary to comply with law, enforce these Terms, protect users, prevent abuse, or preserve platform integrity. Where required by law or where appropriate in the circumstances, we may provide reasons for a restriction decision and information on available review channels. In urgent cases involving safety, fraud, impersonation, or apparent illegality, we may act before notifying the affected user.
7. Reporting illegal or prohibited content
Any user or third party may report allegedly illegal content or content that violates these Terms by emailing pusto.sk.com@gmail.com or by using a report function made available on the Platform. A notice should include, where possible: the URL or unique identifier of the listing or account; the reason for the report; an explanation of why the content is believed to be illegal or prohibited; the reporter’s name and contact details; and supporting evidence. We will review notices within a reasonable time. Where the notice appears sufficiently precise and adequately substantiated, we may remove or disable access to the relevant content, request clarifications, or reject the notice if unsupported. We may preserve evidence and communicate with public authorities where required by law.
8. Misuse of reporting and misuse of the service
Users must not submit abusive, manifestly unfounded, or automated notices in bad faith. Users must not repeatedly upload manifestly unlawful content or misuse the Platform in a way that creates safety, fraud, or compliance risks. We may temporarily suspend the processing of manifestly unfounded notices from repeat abusers and may suspend users who repeatedly provide manifestly unlawful content or otherwise seriously misuse the service, taking into account the facts and proportionality of the measure.
9. Ownership claims, removals, and intellectual property
If a person claims that a public listing belongs to them, contains their personal data, infringes their rights, or should not be displayed in the way shown on the Platform, they may request correction, de-indexing, ownership linking, or removal using the contact details below. Users grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, store, display, reformat, translate, classify, and distribute content they submit through the Platform to the extent necessary to operate, promote, secure, and improve the service. This license ends when the content is deleted, except to the extent retention is necessary for backups, fraud prevention, dispute handling, or legal compliance. The Platform name, logos, interface, software, databases, and non-user content are protected by intellectual property laws and may not be copied, reverse engineered, or reused except as allowed by law or with our prior written consent.
10. Paid features and promoted listings
We may offer paid services such as promoted listings, visibility boosts, premium tools, employer features, verification-related services, or other add-ons. Prices, billing intervals, and feature descriptions will be shown before purchase. Unless a mandatory consumer law rule requires otherwise, paid visibility features are paid for the opportunity to receive additional exposure and do not guarantee enquiries, sales, rentals, interviews, or any particular ranking or outcome. Refunds are handled under the Paid Features Rules attached to this pack and any mandatory rights available under applicable consumer law.
11. Availability, disclaimers, and liability
The Platform is provided on an “as is” and “as available” basis. We do not warrant uninterrupted access, complete accuracy of third-party or user-provided content, or that any listing will remain available, lawful, or error-free. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law. Subject to that rule, our aggregate liability arising out of or in connection with the Platform is limited to the greater of EUR 200 or the amount paid by the affected user to us during the 12 months preceding the event giving rise to liability. We are not liable for indirect or consequential loss, loss of profits, loss of opportunity, reputational damage, or disputes between users except where such exclusion is prohibited by law.
11a. No Liability for Transactions and User Risk
The Platform acts solely as a technical intermediary and is not a party to any transaction, agreement, or relationship formed between users or third parties. We do not act as an agent, broker, intermediary in negotiations, payment provider, guarantor, or insurer. We do not handle payments between users unless explicitly stated. We do not verify all users, listings, or information published on the Platform. Verification features, where available, are limited in scope and do not guarantee identity, reliability, or legitimacy. Users acknowledge that interacting with other users and engaging in transactions carries inherent risks, including but not limited to fraud, misrepresentation, and non-performance. Users are solely responsible for conducting their own due diligence before entering into any agreement, sending money, sharing personal data, or meeting offline. The Platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to accuracy, safety, reliability, or fitness for a particular purpose. Use of the Platform is at the user’s own risk. The Operator shall not be liable for any loss, damage, dispute, or harm arising from interactions, communications, or transactions between users or with third parties.
12. Indemnity
To the extent permitted by law, users will indemnify and hold harmless the Operator against reasonable losses, claims, fines, costs, and expenses arising from the user’s unlawful content, breach of these Terms, or misuse of the Platform.
13. Suspension, termination, and deletion
Users may stop using the Platform at any time. We may suspend or terminate accounts or access where reasonably necessary to address illegality, fraud, repeated policy breaches, inactivity, security concerns, legal risk, or abuse of the Platform.
